Welcome to XtraSpace (the "Platform"). By accessing or using our website, services, or applications, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
1. Role of XtraSpace as a Mediator
CRITICAL DISCLAIMER: XtraSpace acts strictly as a digital mediator and facilitation platform connecting individuals or businesses offering space ("Hosts") with individuals or businesses seeking to rent space ("Guests").
- No Ownership or Control: XtraSpace does not own, operate, manage, or control any of the spaces listed on the Platform.
- No Liability for Listings: We are not responsible for the accuracy, safety, legality, or quality of any spaces listed by Hosts.
- No Liability for Bookings or Usage: We are not liable for any damages, injuries, disputes, or losses occurring during a booking. Guests use rented spaces entirely at their own risk, and Hosts lease their spaces entirely at their own risk.
2. User Account and Authentication
Users must provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your login credentials (including third-party auth platforms like Google). XtraSpace retains the right to suspend or terminate accounts that violate these terms.
3. Host Responsibilities
By listing a space on XtraSpace, Hosts agree that they have the legal right, authority, and necessary permits to rent the property. Hosts are entirely responsible for setting the price, maintaining the safety of the space, and adhering to local zoning laws and regulations. XtraSpace is not liable for any regulatory fines or property damage incurred by the Host.
4. Guest Responsibilities
Guests agree to use the booked spaces in a respectful, legal, and non-destructive manner. Guests are financially liable to the Host for any damages to the property occurring during the reservation period.
5. Financial Transactions
XtraSpace may utilize third-party payment gateways to process transactions. XtraSpace is not liable for errors made by payment processors. Disputes regarding refunds must be handled between the Host and the Guest according to the Host's specified cancellation policy.
6. Limitation of Liability
IN NO EVENT SHALL XTRASPACE, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (III) ANY INTERACTIONS OR MEETINGS WITH OTHER USERS OF THE PLATFORM.
